How to apply for OPT?

Applying for OPT isn’t an easy process. You always need to be aware of various rules and regulations set by USCIS for F1 visa holders. So you need to know the deadlines, seek the help of an international student center, and know all the requirements to get your OPT application approves. I know it’s a lot, and anyone can easily get confused or miss out on things. But a small mistake can cost you a lot. You might miss out on your opportunity of working in the USA.

So here are a few things you need to know as you apply for OPT:

When to apply?

You can apply for OPT only after you complete at least 9 months of academic studies in a designated school or university of USA.  Once you complete 9 months of education in the USA, you are eligible to apply for pre-completion OPT.

You can apply for post-completion OPT 90 days before completing your graduation or at most 60 days after completion of your graduation. Your application won’t be accepted before or after this time period.

On the OPT application, you need to mention the desired start date of your employment. But you need to remember that you cannot start working before receiving EAD (Employment Authorization Document) from USCIS. Also, you must be physically present in the USA for at least 12 months to be eligible to work in the USA. This application for EAD can take longer than expected, so it is always advisable that you apply for OPT. It’s not necessary to have a job in advance to apply for OPT.

To apply for OPT, you need to follow the below-mentioned application steps:

Someone from the international student center or an advisor will surely help you in the process, but you need to make sure you keep ready all the important documents and certificates to avoid wasting a lot of time. So here is the list of things you will need.

I-765 Form:

This is one of the most important applications for employment authorization that needs to be submitted to USCIS, to get a work permit. You can download all the required information from the USCIS site to check the process to receive it from your school.

OPT Recommendation Form:

Your school will have a required OPT recommendation form mentioning the start and end date and other specifics of your proposed OPT

$380 Filing Fee:

You will need to pay this amount every time you apply for EAD, usually for post-completion and pre-completion OPT. You can use a personal check, cashier check, or any other method to pay it. If you are paying through a check, write the date of birth, and SEVIS ID number on the front of the check.

Two passport-style photos:

Coloured photos taken within 30 days of filing an application form. Although there are certain specifications in the I-765 form but passport photos will do. Do not forget to mention the SEVIS ID number.

Document Copies:

Not necessary, but if you have documents like Form I-94 Arrival/Departure Record Card (Both Front and Back), EAD Card, most recent I-20 (pages 1 & 3) and a passport ID page you will need to submit its copies.

It is always advisable to have a discussion with your international student advisor or someone in the international student center about the process of applying for OPT as soon as possible to avoid getting to trouble or miss out on good opportunities.

OPT CPT Students

How to Apply?

Generally, you must:

  1. Request that your designated school official (DSO) at your academic institution recommend the OPT.
  2. Your DSO will make the guidance by endorsing your Form I‑20, Certification of Eligibility for Non immigrant Student Status, and making the appropriate notation in the Student and Exchange Visitor Information System (SEVIS).
  3. Properly file Form I-765, Application for Employment Authorization with USCIS, accompanied by the required fee and the supporting documentation as described in the form instructions.

USCIS OPT Processing Time

  • From point of approval, USCIS says it can take 30 days beyond to receive your EAD card
  • Most cards arrive within 7-10 days after approval.
  • In total, it is likely for your OPT application to take 90-120 days.
OPT CPT
OPT is a 12-month work authorization provided to international students related to their field of study. International students have the benefit of working on CPT which has to be directly related to their core subjects.
OPT can be completed before or after graduation. CPT must be completed before graduation.
To be eligible for the OPT; the students must be pursuing the studies for minimum one year. After the completion of the full OPT period, the students are not eligible to apply for the CPT.
In order to receive OPT authorization, students do not require any employment or job offer. While applying for CPT Jobs in USA students require a job or an employment offer.
OPT has two parts. The pre-completion OPT is the job done while the student is studying and the post-completion opt is the OPT work authorization after completing graduation. CPT is a total of 12 months and it can be either full-time or part-time.
OPT students need not work continuously for the 12 months, they can work in breaks and stops. There is also a possibility of the extension of the OPT period. CPT requires students to work for the 12 months but once they have used the full CPT period, you lose your eligibility for OPT.
The OPT work can be part-time as well as full time for the eligible students. The work can be done part-time as well as full time for the CPT students.
The OPT Work the student’s employment experience must be related to their field of graduation but not necessarily the academic curriculum and you do not need to earn course credit. To work for CPT, the employer has to have a direct effect on employment. CPT must be required by your major and if it is not, CPT work must receive course credit and would directly affect the curricular credit of the student.
Students on OPT have the freedom to work with any employer. They can work with any company across the USA. A student who is on CPT is not allowed with every employer but under only those who are on SEVP.
OPT is not employer specific and allows work, not an internship or co-op. CPT is part of your major that allows students to work in a paid or unpaid internship, practicum, or cooperative (co-op) education program.
